We collect only what is necessary to operate ElementWatch:
Subscription billing is handled by our payment processor (Stripe). We may receive and store limited billing metadata such as customer ID, subscription ID, plan, billing status, invoice status, transaction dates, and the last four digits or brand of a payment method where provided by the processor. We do not receive or store full card numbers, CVV codes, or bank account credentials. Your payment information is governed by Stripe's privacy policy and security practices.
ElementWatch is not designed to receive confidential, regulated, personal, health, financial account, export-controlled, classified, children's, or highly sensitive information. Do not submit such information into search, calculator, AI, or support features. If you submit information to the Service, you represent that you have the right to do so and that the submission does not violate law, contract, confidentiality obligations, or third-party rights.
We use service providers to operate ElementWatch, including hosting, authentication, payment processing, AI inference, analytics, email, security, and support providers. We require service providers to process personal information only as needed to provide services to us, maintain security, prevent abuse, comply with law, and support business operations.
For security and procurement purposes, we may provide a current list of material sub-processors to business subscribers upon reasonable written request or under NDA. Contact tom@phase3ai.com to request this list.
Paid AI features may send your queries and necessary context to an AI inference provider to return a response. We do not authorize our AI provider to use customer queries to train models unless we expressly disclose that practice and obtain any consent required by law. You should not submit personally identifiable, confidential, privileged, regulated, or sensitive information into AI features. AI-generated output may contain errors and should be independently verified before reliance.
We do not use personal information for targeted advertising. We do not sell personal information.
For ordinary account, subscription, billing, analytics, and support data, SapienCX LLC acts as an independent data controller. To the extent a business customer submits personal data to ElementWatch through paid features, we process that information only to provide the Service, maintain security, prevent abuse, comply with law, and operate our business. You remain responsible for any personal data you choose to submit and for providing any required notices or obtaining any required consents from individuals whose data you submit.
Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of certain personal information, and to appeal certain privacy decisions. To exercise these rights, email tom@phase3ai.com. We will respond within 30 days and may verify your identity before acting on your request.
We do not sell personal information. We do not share personal information for cross-context behavioral advertising as defined under the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA). We do not use personal information for targeted advertising unless expressly disclosed in this Policy.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption in transit (TLS) and at rest. No internet service can be guaranteed secure. If we determine that a security incident requires notification, we will notify affected users without undue delay and within the time required by applicable law.
ElementWatch is operated from the United States. If you access the Service from outside the United States, your information may be processed in the United States or other jurisdictions where our providers operate. Where required by law, we use appropriate transfer mechanisms or rely on lawful transfer bases.
Account data is retained while your subscription is active and for a reasonable period after cancellation for legal, tax, accounting, security, and dispute purposes, then deleted. Billing records are retained as required by applicable law. Usage analytics are aggregated or de-identified where feasible. You may request earlier deletion subject to our legal retention obligations.
ElementWatch is not intended for children and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child submitted personal information, contact us at tom@phase3ai.com and we will take appropriate steps to delete it.
ElementWatch may display links to third-party sources (EIA, USGS, news publishers, etc.) for source attribution. These third parties have their own privacy practices. We are not responsible for the privacy practices of linked third-party sites.
We may update this Policy and will maintain a dated archive of each published version. Material changes will be notified to active subscribers via email before they take effect. Continued use after the effective date constitutes acceptance of the revised Policy.
